稅務問答／遺產分割 無須課贈與稅

台南市陳先生詢問：日前繳清遺產稅，要辦理遺產協議分割登記，大哥取得較多，我和小弟所分遺產較少，我和小弟是否涉及贈與大哥財產？

南區國稅局台南分局答覆：繼承人間自行協議分割遺產，於分割遺產時，經協議其中部分繼承人取得較其應繼分為多之遺產者，民法並未限制；繼承人取得遺產之多寡，不與應繼分相同，也不發生繼承人間相互贈與的問題。因此，陳先生兄弟間如何協議分割遺產，均不課徵贈與稅。
